Reasonable Adjustments and Return to Work Policy
Purpose
Wilson Vale Catering Ltd ("the Company") is committed to creating an inclusive working environment where employees are supported to remain in work wherever possible and to return to work safely and successfully following periods of illness or injury.
The purpose of this policy is to provide a clear framework for considering reasonable adjustments and supporting employees who may be experiencing health-related difficulties in the workplace. The Company recognises that employees may require different forms of support at different times and is committed to considering each situation individually, fairly and sensitively.
The policy also aims to ensure compliance with the Company's legal obligations while balancing operational requirements and maintaining effective service delivery.
This policy does not form part of an employee’s contract of employment and Wilson Vale Catering may amend this policy at any time.
Scope
This policy applies to all employees of Wilson Vale Catering Ltd.
The policy may be relevant where an employee has a disability, long-term health condition, injury, illness, mental health condition or any other circumstance that affects their ability to carry out their role in the usual way. Support may be appropriate on either a temporary or long-term basis, depending on the employee's circumstances.
This policy should be read alongside the Company's Sickness Absence Policy, Capability Policy and other related policies.
Introduction
Wilson Vale is committed to treating employees with dignity, fairness and respect throughout any process involving health concerns, workplace adjustments or a return to work following absence.
The Company recognises that every employee's circumstances are different and that adjustments which are appropriate in one situation may not be appropriate in another. Decisions will therefore be based on the individual circumstances of each case rather than a standardised approach.
The Company is committed to engaging openly and constructively with employees to understand their needs and explore practical solutions. Wherever possible, adjustments will be considered collaboratively, taking account of medical advice, operational requirements and the employee's views.
Wilson Vale Catering also recognises the importance of maintaining operational effectiveness and ensuring that any adjustments implemented remain practical, sustainable and safe for both the employee and the wider workforce.
Examples of Reasonable Adjustments
Reasonable adjustments may take many forms depending on the individual circumstances of the employee and the nature of their role.
Examples may include amended working hours, phased returns following sickness absence, temporary or permanent modifications to duties, changes to working practices, workplace adaptations, specialist equipment, additional breaks, support for medical appointments, flexible working arrangements or accessible communication methods.
The examples provided are illustrative only and should not be regarded as creating an automatic entitlement to any specific adjustment.
Requesting and Considering Adjustments
Employees may raise concerns regarding their health or request support at any time. Requests can be made verbally or in writing to a line manager or the Human Resources Department. An employee does not need to use the phrase "reasonable adjustment" in order for the Company to consider whether support may be appropriate.
When a request is received, the Company will seek to understand the circumstances giving rise to the request and the effect those circumstances are having on the employee's ability to carry out their role. Consideration will be given to any adjustments proposed by the employee together with any reasonable alternatives that may achieve a similar outcome.
The Company may obtain further information where this is considered necessary to reach an informed decision. This could include medical advice, Occupational Health input or discussions with the employee regarding the practical difficulties they are experiencing.
Any decision will take account of the needs of the employee, the effectiveness of the proposed adjustment, operational requirements and any relevant health and safety considerations. Outcomes will normally be communicated to the employee verbally or in writing and reviewed where appropriate. The Company is committed to taking a practical and supportive approach to workplace adjustments. Where a reasonable adjustment is clear, straightforward and capable of being implemented without the need for a formal assessment process, the Company will aim to make the adjustment as soon as reasonably practicable in order to provide timely support to the employee.
Medical Information and Occupational Health
In order to understand the impact of a health condition or disability, the Company may seek medical information from appropriate sources. This may include Occupational Health referrals, GP reports, specialist reports, consultant opinions or other relevant medical evidence.
Medical information assists the Company in understanding an employee's functional capabilities, restrictions, prognosis and any recommendations regarding adjustments or fitness for work.
Medical information will be treated confidentially and processed in accordance with applicable data protection legislation. Consent will be sought in all cases. Where an employee chooses not to provide medical information or consent to an assessment, decisions may need to be made based on the information available at the time.
Meetings and Communication
The Company may arrange meetings (face to face or via Teams) with employees to discuss their health, workplace support requirements and return-to-work arrangements. Such meetings provide an opportunity for employees to explain any difficulties they are experiencing and enable the
Company to explore potential solutions. Where appropriate, employees may be accompanied by a trade union representative or workplace colleague. Where communication barriers exist, the Company will consider reasonable steps to facilitate effective participation, including interpreters or alternative communication methods where appropriate.
Return to Work
Wilson Vale recognises the value of supporting employees in returning to work following periods of absence. In order to understand the capabilities/ limitations, adjustments it may be necessary to complete a risk assessment with the person
A return-to-work discussion may take place before an employee returns or shortly afterwards. The purpose of these discussions is to understand any ongoing health concerns, identify barriers to returning to work and consider whether any temporary or permanent support may be required.
The Company will seek to facilitate a safe and sustainable return wherever reasonably practicable while ensuring operational requirements continue to be met.
Phased Returns
Where appropriate, a phased return to work may be agreed following a period of sickness absence.
A phased return may involve a temporary reduction in working hours, amended duties or a gradual increase in responsibilities over an agreed period. Such arrangements are intended to support employees in rebuilding capacity and confidence while managing any ongoing health issues.
Phased return arrangements will normally be reviewed at agreed intervals and do not automatically result in a permanent change to contractual terms and conditions.
Temporary and Permanent Adjustments
Some adjustments may be required for a limited period, while others may be longer term in nature.
Where temporary arrangements are implemented, review dates will normally be agreed with both parties so that the effectiveness of the adjustment can be assessed. Long-term arrangements may also be reviewed periodically to ensure they remain appropriate and effective.
The Company reserves the right to amend arrangements where circumstances change, medical advice changes or operational requirements evolve.
Operational Considerations
The Company recognises that reasonable adjustments must be assessed within the context of the employee's role, working environment and operational responsibilities.
In determining whether a proposed adjustment is reasonable, consideration will be given to the extent to which it removes or reduces any disadvantage experienced by the employee, together with the wider impact on service delivery, staffing levels, operational effectiveness, client requirements and health and safety obligations. Where a particular adjustment cannot reasonably be accommodated, the Company will seek to explore alternative solutions where possible. Decisions will be based on the individual circumstances of each case and supported by appropriate evidence and documentation.
Client and Contract Requirements
As a contract catering business, Wilson Vale employees may work within client locations with specific operational requirements and contractual arrangements.
Whilst client requirements may be relevant considerations, the Company will make its own assessment regarding requests for support and workplace adjustments. A client preference alone will not automatically determine whether an adjustment can be accommodated or whether an employee can continue in a particular role.
Where issues arise in relation to deployment at a client location, the Company will consider all relevant circumstances, including operational requirements, available adjustments and alternative duties.
Alternative Work
Where an employee is unable to carry out some or all aspects of their normal role, the Company may consider whether suitable alternative duties or alternative employment opportunities are available.
Any consideration of alternative work will depend upon business needs, availability of vacancies and the employee's skills, experience and capabilities at the relevant time. The Company is not required to create entirely new roles but will consider reasonable alternatives where appropriate.
Reviewing Adjustments
The Company recognises that an employee's needs may change over time.
Adjustments will therefore be reviewed periodically to ensure they remain effective and continue to meet both the employee's needs and operational requirements. Reviews may also take place following changes in medical circumstances, job duties, workplace arrangements or business requirements.
Employee Responsibilities
Employees are expected to engage constructively and honestly in discussions relating to their health, wellbeing and any workplace support they may require.
Employees should provide information that is reasonably necessary for the Company to understand their circumstances, participate in meetings where they are medically able to do so and inform the Company of any significant changes that may affect agreed arrangements.
The Company recognises that some health conditions may impact an employee's ability to engage fully with the process and will seek to provide appropriate support where required.
Manager Responsibilities
Managers play a key role in supporting employees who require workplace adjustments or assistance in returning to work.
Managers are expected to approach such situations sensitively and objectively, avoid making assumptions regarding an employee's capabilities and seek guidance from Human Resources where appropriate. Managers should ensure that requests are considered fairly, discussions are appropriately documented and agreed arrangements are implemented and reviewed in a timely manner.
Human Resources Responsibilities
Human Resources is responsible for supporting the consistent application of this policy across the business.
HR will provide guidance to managers and employees, coordinate Occupational Health referrals where appropriate, support return-to-work planning and assist with the consideration of employment and equality law obligations. HR will also maintain appropriate records and provide additional support in complex cases where required.
Confidentiality and Data Protection
Information relating to an employee's health will be treated as confidential and handled in accordance with applicable data protection legislation.
Such information will only be shared with individuals who have a legitimate business need to know. Where workplace adjustments require communication with colleagues, only the minimum information necessary will normally be disclosed.
Capability Considerations
In some circumstances, despite appropriate support, adjustments and medical intervention, an employee may remain unable to perform the requirements of their role.
Where this occurs, the Company may consider the matter under its Capability Policy. Before any capability decision is reached, the Company will consider all relevant information, including medical evidence, Occupational Health advice where appropriate, adjustments already considered or implemented, potential alternative employment and any other relevant circumstances.
Where the Equality Act 2010 applies, the Company will ensure that reasonable adjustment obligations have been properly considered before any decision is made.
Policy Review
The Company will review this policy periodically to ensure it remains compliant with legal requirements, reflects best practice and continues to meet the operational needs of the business.
Any amendments to the policy will be communicated as appropriate.
